After the application is made in the prescribed manner the officer of the trade mark will consider and examine the same. An examination report will be sent to the applicant and if there is any shortcoming or incompleteness in it or if it is found that it is similar to any existing mark or is not capable to distinguish it from that of the others then an objection will be there in the report along with the reasons as per the relevant provisions and rules made under Trade Mark Act, 1999. The officer will grant a prescribed time to file a reply.
The applicant must be prepared well in advance to file reply and if it is not filed within time along with valid counter arguments and documents then it will render the application as abandoned.
