Once a trade mark is accepted it is advertised in a monthly trade mark journal for public. Any person whether having commercial or personal interest or not having any interest can file a notice of opposition under Section-21(1) in Form TM-O within 4 months from the date of publication in the trade mark journal along with fee and the reasonable grounds and reasons for the same. Such application can be made online at ipindiaonline.gov.in and shall contain the application number against which opposition is made, name of the applicant, type of goods and services etc.
After receiving the notice of opposition the registrar shall forward a copy of the same to the applicant of the trade mark granting 2 months to file the counter statement along the necessary documents and evidences. The applicant shall file the counter statement in Form TM-O within 2 months of receipt of the same.
