In India a registered trade mark is valid for a period of 10 years from the date of its application for registration and can be renewed from time to time to avoid any inconvenience. An application for renewal of registration for trade mark can be made in Form TM-R along with the prescribed documents and fee. Such an application shall be made by the applicant of his agent not more than 1 year before the expiration of earlier registration. Such renewal will be valid for another 10 years and so on.
If the applicant fails to make an application to the registrar for renewal of trade mark within time then the registrar shall send a notice to the applicant not more than six months before the expiration of registration intimating the approaching date of expiration.
